Its health system especially was gravely harmed.&nbsp;</p> <p>&nbsp;</p> <p>Many services and life-saving treatments aren't available. Accessing it elsewhere is uncertain and tenuous. Treating chronic illnesses is jeopardized by inadequate medicines and proper equipment.</p> <p>&nbsp;</p> <p>Regular Israel incursions and air attacks exacerbate bad conditions. So do deficient fuel and electricity supplies, as well as unsafe drinking water and other health hazards.</p> <p>&nbsp;</p> <p>Conditions are getting worse, not better. In September <a href="http://www.phr.org.il/uploaded/September_Declaration__ENG_Final.pdf"><span>Physicians for Human Rights/Israel (PHR/I)</span></a> said:</p> <p>&nbsp;</p> <p>"Israel glaringly violate(s) the rights of Palestinians to health, each time in a different manner." It said the right to health "extends to (its) underlying determinants, (including) food and nutrition, housing, access to safe and potable water and adequate sanitation, safe and healthy working conditions, and a healthy environment."</p> <p>&nbsp;</p> <p>By imposing draconian impediments, Palestinians, especially Gazans, lack proper health services. As a result, lives are lost and human suffering aggravated.</p> <p>&nbsp;</p> <p>"As these lines are being written, we are witnessing a grave crisis in the Gaza health system." Its Ministry of Health reports dozens of medications in short supply or exhausted. Moreover, 123 types of medical equipment are unavailable. Dozens of others need replacing.</p> <p>&nbsp;</p> <p>Israel's Gaza policy is "humanitarian minimum." Often it's non-existent. Gaza lurches from one crisis to another. Duct tape solutions won't solve it.&nbsp;</p> <p>&nbsp;</p> <p>Absent change, "it is difficult to anticipate an end to the daily suffering of the sick and infirm individuals residing in these territories," especially besieged Gazans.</p> <p>&nbsp;</p> <p>As an occupying power, Israel bears full responsibility. Nonetheless, it willfully and systematically breaches its international law obligations. As a result, Gazans suffer horrifically, especially on accessing healthcare when it's most needed.</p> <p>&nbsp;</p> <p>On December 4, the <a href="http://www.pchrgaza.org/portal/en/?option=com_content&amp;view=article&amp;id=7905:pchr-concerned-over-medical-shortages-in-gaza-strip-hospitals-&amp;catid=36:pchrpressreleases&amp;Itemid=194"><span>Palestinian Center for Human Rights (PCHR) </span></a>expressed concern over medical shortages in Gaza's hospitals, saying:</p> <p>&nbsp;</p> <p>Critical shortages of medicines affect healthcare. Repercussions are potentially catastrophic, "especially (for) patients and those suffering chronic diseases...."</p> <p>&nbsp;</p> <p>According to Ministry of Health Director General of Pharmacy Dr. Muneer al-Bursh, health facilities and warehouses exhausted 120 essential medicines and 140 medical goods.</p> <p>&nbsp;</p> <p>In 2011, Ramallah's Ministry of Health supplied only 20% of Gaza's medicinal needs. Shortages of goods like Blood Line used in dialyses threatens the lives of 400 patients currently.</p> <p>&nbsp;</p> <p>Moreover, medicines for cancer, anesthesia, immune system inhibiters for kidney transplant patients (received abroad), and hemophilia have run out entirely.</p> <p>&nbsp;</p> <p>At the same time, Ramallah Minister of Health director Dr. Fathi Abu Mughli said West Bank hospitals have adequate supplies. In fact, he claimed they're better stocked than in other regional countries, except when warehouse deliveries are delayed by Israeli imposed policies. Even so, alternative drugs and treatment are available.</p> <p>&nbsp;</p> <p>Mahmoud Abbas and other PA officials haven't addressed the problem. As a result, dozens of lives are endangered, especially after the Ministry of Health decreased transferring critically ill patients for treatment "under the claim of rationalizing medical transfers from" Gaza.</p> <p>&nbsp;</p> <p>On November 2, Ramallah's Ministry of Health decreased transfers to Israeli and other hospitals. At issue was cost, it was claimed. When possible, accessing treatment in Israel is preferable because of proximity compared to Egypt and Jordan.</p> <p>&nbsp;</p> <p>Cancer patients are especially at risk. Treatment isn't available in Gaza. Often it's lacking in West Bank and East Jerusalem hospitals. As a result, "(t)wo children died as they urgently needed advanced medical treatment, but the Ministry of Health transferred them to hospitals that cannot treat their diseases."</p> <p>&nbsp;</p> <p>On November 4, Mohammed Azzam Sahwil died from growth retardation and muscle atrophy. In serious condition, he was admitted to Gaza's al-Nasser Hospital's intensive care unit.</p> <p>&nbsp;</p> <p>The Ministry of Health officials knew his situation. On &nbsp;October 25, Form No. 1 to receive medical treatment abroad was obtained. On November 2, financial coverage was gotten for treatment at Jerusalem's al-Maqassed Hospital. He was refused admittance for lack of ability to treat him.</p> <p>&nbsp;</p> <p>The Ministry of Health was informed but didn't act. As a result, he died at Gaza's al-Nasser Hospital. Less than a month later, his sister, Hiba Azzam Sahwil, also succumbed from the same illness.&nbsp;</p> <p>&nbsp;</p> <p>She also got permission for treatment abroad and financial coverage at Jerusalem's al-Maqassad Hospital. An appointment was arranged for December 13. However, she'd already deteriorated too much to help. Nonetheless, the Ministry of Health was asked to immediately transfer her to Israel's Ekhilov Hospital. It refused. On December 1, she died.</p> <p>&nbsp;</p> <p>A third sibling suffers from the same disease, Ayat Azzam. She also got permission for outside treatment and financial coverage. It also wrote West Bank Director General of Medical Insurance Nizar Masalma, "demanding (he) allow 24 patients who suffer from serious chronic diseases continue to receive treatment in advanced medical facilities." So far, he hasn't responded.</p> <p>&nbsp;</p> <p>A Final Comment</p> <p>&nbsp;</p> <p>The <a href="http://english.wafa.ps/?action=detail&amp;id=18248"><span>Palestine News &amp; Information Agency (WAFA)</span></a> headlined, "Official Warns of Israel Ethnic Cleansing Policy in (East) Jerusalem," saying:</p> <p>&nbsp;</p> <p>PLO Jerusalem affairs head Ahmed Qurei warned of "Israel's quiet ethnic cleansing and displacement policy against" East Jerusalem Palestinians.&nbsp;</p> <p>&nbsp;</p> <p>Home demolitions are responsible in East Jerusalem's Old City, as well as in Sheikh Jarrah, Silwan, and other Palestinian neighborhoods. He stressed that Israel plans Judaizing all Jerusalem, one home demolition at a time.</p> <p>&nbsp;</p> <p>Meanwhile, <a href="http://www.maannews.net/eng/ViewDetails.aspx?ID=442262"><span>UNWRA</span></a> (UN Relief and Works Agency) spokesman Chris Gunness said 2011 Israeli home demolitions doubled last year's total.</p> <p>&nbsp;</p> <p>Its research found 990 Palestinians, including 507 children, were displaced. About 515 West Bank and East Jerusalem structures were demolished. Gunness called losing a home in normal times "highly destabilizing, but in the context of occupation and annexation it often becomes lastly traumatic, especially for children."</p> <p>&nbsp;</p> <p>"The United Nations calls on the Israeli authorities to abide by their obligations under international law, of which these displacements and demolitions are a clear violation."</p> <p>&nbsp;</p> <p>"Call(ing) on" has no impact. Only policy measures with teeth can help. For decades, they've been sorely lacking. As a result, Israel literally gets away with crimes of war and against humanity, including ethnically cleansing Palestinians from all land it wants for Jewish only development.</p> <p>&nbsp;</p> <p>Instead of acting responsibly for justice, world leaders support Israel's worst policies. Palestinians pay dearly, especially Gazans suffocating needlessly under siege.</p> <p>&nbsp;</p> <p>Moreover, according to former IDF head General (ret.) Yoav Galant, military action is needed to root out Gaza's "terror infrastructure." In other words, he urges mass murder.</p> <p>&nbsp;</p> <p>In addition, <a href="http://www.haaretz.com/print-edition/opinion/netanyahu-cares-about-power-not-affordable-living-1.399548"><span>Haaretz</span></a> said Netanyahu cares only about power and "giving in to cronyism and vested interests."&nbsp;</p> <p>&nbsp;</p> <p>Like America, Israel's decaying from within. Both countries use militarism, conflict and violence to solve problems. Popular needs go begging.&nbsp;</p> <p>&nbsp;</p> <p>Palestinians and Israeli Arabs suffer horrifically. So do deprived and persecuted Americans. Both countries are global bullies. They're rogue state partners in intimidation, state terror, and torment.&nbsp;</p> <p>&nbsp;</p> <p>Their leaders are moral cowards. Calling them democracies is ludicrous and offensive. Nations that live by the sword, die by it.&nbsp;</p> <p>&nbsp;</p> <p>Israel and America aren't exceptions. Nonetheless, Israel refuses to let diaspora Palestinians return home. It calls doing so an "act of suicide," disruptive of its tenuous majority.</p> <p>&nbsp;</p> <p>It cites UN Resolutions 242 and 338. They mandate political solutions for Palestine's refugee problem, exclusive of international law, human rights, equity and justice. As a result, durable solutions are blocked.</p> <p>&nbsp;</p> <p>Israel calls right of return issues a privilege, not a right. Palestinian self-determination is thus severely compromised. Millions are left unprotected.</p> <p>&nbsp;</p> <p>An October <a href="http://www.badil.org/"><span>BADIL</span></a> Resource Center for Palestinian Residency and Refugee Rights Working Paper No. 12 headlined, "Applying International Criminal Law to Israel's Treatment of the Palestinian People," saying:</p> <p>&nbsp;</p> <p>Since established in 1948, Israel institutionalized land theft and Palestinian dispossessions. Through 2009, "displaced Palestinians amounted to at least 7.1 million."</p> <p>&nbsp;</p> <p>About 70% of West Bank land (including East Jerusalem) has been confiscated or subjected to restricted use. In addition, Israel's Gaza buffer zone prevents Palestinians from using 17% of their land and 35% of its arable portion.</p> <p>&nbsp;</p> <p>Within Israel, 94% of land is exclusively Jewish. "The Israeli domination over the Palestinian people continues unabated and the policy of displacement, illegal acquisition of land and denial of return, repatriation, restitution and compensation has intensified recently in various areas, for example in East Jerusalem and Area C of the West Bank."</p> <p>&nbsp;</p> <p>Israel displaces Palestinians violently. Indiscriminate force is used. Home demolitions and dispossessions happen regularly. Residency rights are revoked. Closure, segregation, collective punishment, expropriation, discriminatory land distribution, attacks, arrests, detentions, assassinations, torture, and settlement expansions are policy.</p> <p>&nbsp;</p> <p>BADIL says:</p> <p>&nbsp;</p> <p>"Palestinian displacement and dispossession are caused by a policy of forced population transfer which has been employed by the Zionist movement and the state of Israel with the aim to colonize Palestinian land and establish a Jewish demographic majority in it."</p> <p>&nbsp;</p> <p>It persists despite international law prohibitions against colonialism and apartheid because world community leaders with authority to stop it don't act.</p> <p>&nbsp;</p> <p>Nor do they mourn victims like Mustafa Tamimi. On December 11, thousands of Palestinians protested his killing. On December 9, a-Nabi Saleh demonstrators turned out against settlers taking their land.</p> <p>&nbsp;</p> <p>A soldier fired a tear-gas canister directly at his head, critically wounding him. Evacuated to Israel's Beilinson Hospital, he died the next day. About 2,000 mourners turned out. PLC committee against settlements head Walif Assaf told them:</p> <p>&nbsp;</p> <p>"They want to turn our unarmed struggle into an armed struggle. But this will not change our policy of peaceful struggle against settlements and against the occupation."</p> <p>&nbsp;</p> <p>After his burial, clashes broke out as hundreds of mourners marched toward Israeli soldiers near the funeral proceeding. Some threw stones. Tear gas was fired in response.</p> <p>&nbsp;</p> <p>Tamimi was the 20th person killed this way in the past eight years. <a href="http://www.btselem.org/firearms/20111209_killing_of_mustafa_tamimi"><span>B'Tselem</span></a> spokeswoman Sarit Michaeli said the organization called for a full military probe into who fired the canister, who ordered it, and why it was aimed at Tamimi's head at point blank range.</p> <p>&nbsp;</p> <p>Earlier in response to B'Tselem's demands, then Judea and Samaria legal advisor Col. Sharon Afek said "direct firing (of tear gas canisters) at persons is prohibited," and that "very soon, a explicit and broad directive will be issued" to prohibit it.</p> <p>&nbsp;</p> <p>Later after other incidents occurred, Judea and Samaria legal advisor Major Uri Sagi told B'Tselem that "following your letter, we have again clarified to the forces operating in Central Command the rules relating to firing of tear-gas canisters at persons, including the prohibition on directly firing" them at anyone.</p> <p>&nbsp;</p> <p>Other senior military officials said such firings don't occur. However, B'Tselem documented more cases in which security forces targeted protesters illegally. No one was prosecuted. Investigations were whitewashed. Soldiers literally get away with murder. Israel denies free expression and assembly violently.</p> <p>&nbsp;</p> <p>On December 9, the UN General Assembly passed nine resolutions related to Palestine among 24 and two texts related to human rights and decolonization.</p> <p>&nbsp;</p> <p>Several resolutions passed near unanimously. Only Israel voted against them. One called for accelerating the right of return and asked donor countries to help the United Nations Relief and Works Agency for Palestinian Refugees (UNRWA) cover costs.</p> <p>&nbsp;</p> <p>Another urged Israel to reimburse UNRWA for transit charges and other financial losses sustained by delays and restrictions on movement and access.</p> <p>&nbsp;</p> <p>Five resolutions referred to a report from the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs of the Occupied Territories. They related to Israeli practices and obligations under Fourth Geneva.</p> <p>&nbsp;</p> <p>Others dealt with the impact of Israeli settlement policies, decisions and activities related to peace process negotiations. Since 1947, Israel voted against dozens of resolutions related to its lawless policies.</p> <p>&nbsp;</p> <p>A Final Comment</p> <p>&nbsp;</p> <p>In a December 10 Republican candidate debate, Newt Gingrich called Palestinians "terrorists. They teach terrorism in their schools. They have textbooks that say, if there are 13 Jews and nine Jews are killed, how many Jews are left? We pay for those textbooks through our aid money."</p> <p>&nbsp;</p> <p>"It's fundamentally time for somebody to have the guts to stand up and say, enough lying about the Middle East."</p> <p>&nbsp;</p> <p>Gingrich also told the Jewish cable channel, "Remember there was no Palestine as a state. It was part of the Ottoman empire. (Palestinians were) an invented people who are in fact Arabs."</p> <p>&nbsp;</p> <p>Except for Ron Paul on sound money, returning it to public hands, ending America's imperial wars, drug ones also, opposing police state laws, and promoting real economic growth, Republican presidential aspirants look more like a police lineup than legitimate candidates for any office.&nbsp;</p> <p>&nbsp;</p> <p>Gingrich is one of the worst. Comments like those above show it. PLO Executive Committee Hanan Ashrawi called him out of "touch with reality."&nbsp;</p> <p>&nbsp;</p> <p>Other Palestinian officials demanded he apologize. Inflammatory comments further damage America's tattered credibility. In serious condition, he was admitted to Gaza's al-Nasser Hospital's intensive care unit.</p> <p>&nbsp;</p> <p>The Ministry of Health officials knew his situation. On &nbsp;October 25, Form No. 1 to receive medical treatment abroad was obtained. On November 2, financial coverage was gotten for treatment at Jerusalem's al-Maqassed Hospital. He was refused admittance for lack of ability to treat him.</p> <p>&nbsp;</p> <p>The Ministry of Health was informed but didn't act. As a result, he died at Gaza's al-Nasser Hospital. Less than a month later, his sister, Hiba Azzam Sahwil, also succumbed from the same illness.&nbsp;</p> <p>&nbsp;</p> <p>She also got permission for treatment abroad and financial coverage at Jerusalem's al-Maqassad Hospital. An appointment was arranged for December 13. However, she'd already deteriorated too much to help. Nonetheless, the Ministry of Health was asked to immediately transfer her to Israel's Ekhilov Hospital. It refused. On December 1, she died.</p> <p>&nbsp;</p> <p>A third sibling suffers from the same disease, Ayat Azzam. She also got permission for outside treatment and financial coverage. Ramallah's Health Ministry was urged to save her. On December 1, admittance to Israel's Ekhilov Hospital was gotten.</p> <p>&nbsp;</p> <p>PCHR is following her case to help. It also wrote West Bank Director General of Medical Insurance Nizar Masalma, "demanding (he) allow 24 patients who suffer from serious chronic diseases continue to receive treatment in advanced medical facilities." So far, he hasn't responded.</p> <p>&nbsp;</p> <p>A Final Comment</p> <p>&nbsp;</p> <p>The <a href="http://english.wafa.ps/?action=detail&amp;id=18248"><span>Palestine News &amp; Information Agency (WAFA)</span></a> headlined, "Official Warns of Israel Ethnic Cleansing Policy in (East) Jerusalem," saying:</p> <p>&nbsp;</p> <p>PLO Jerusalem affairs head Ahmed Qurei warned of "Israel's quiet ethnic cleansing and displacement policy against" East Jerusalem Palestinians.&nbsp;</p> <p>&nbsp;</p> <p>Home demolitions are responsible in East Jerusalem's Old City, as well as in Sheikh Jarrah, Silwan, and other Palestinian neighborhoods. He stressed that Israel plans Judaizing all Jerusalem, one home demolition at a time.</p> <p>&nbsp;</p> <p>Meanwhile, <a href="http://www.maannews.net/eng/ViewDetails.aspx?ID=442262"><span>UNWRA</span></a> (UN Relief and Works Agency) spokesman Chris Gunness said 2011 Israeli home demolitions doubled last year's total.</p> <p>&nbsp;</p> <p>Its research found 990 Palestinians, including 507 children, were displaced. About 515 West Bank and East Jerusalem structures were demolished. Gunness called losing a home in normal times "highly destabilizing, but in the context of occupation and annexation it often becomes lastly traumatic, especially for children."</p> <p>&nbsp;</p> <p>"The United Nations calls on the Israeli authorities to abide by their obligations under international law, of which these displacements and demolitions are a clear violation."</p> <p>&nbsp;</p> <p>"Call(ing) on" has no impact. Only policy measures with teeth can help. For decades, they've been sorely lacking. As a result, Israel literally gets away with crimes of war and against humanity, including ethnically cleansing Palestinians from all land it wants for Jewish only development.</p> <p>&nbsp;</p> <p>Instead of acting responsibly for justice, world leaders support Israel's worst policies. Palestinians pay dearly, especially Gazans suffocating needlessly under siege.</p> <p>&nbsp;</p> <p>Moreover, according to former IDF head General (ret.) Yoav Galant, military action is needed to root out Gaza's "terror infrastructure." In other words, he urges mass murder.</p> <p>&nbsp;</p> <p>In addition, <a href="http://www.haaretz.com/print-edition/opinion/netanyahu-cares-about-power-not-affordable-living-1.399548"><span>Haaretz</span></a> said Netanyahu cares only about power and "giving in to cronyism and vested interests."&nbsp;</p> <p>&nbsp;</p> <p>Like America, Israel's decaying from within. Both countries use militarism, conflict and violence to solve problems. Popular needs go begging.&nbsp;</p> <p>&nbsp;</p> <p>Palestinians and Israeli Arabs suffer horrifically. So do deprived and persecuted Americans. Both countries are global bullies. They're rogue state partners in intimidation, state terror, and torment.&nbsp;</p> <p>&nbsp;</p> <p>Their leaders are moral cowards. Calling them democracies is ludicrous and offensive. Nations that live by the sword, die by it.&nbsp;</p> <p>&nbsp;</p> <p>Israel and America aren't exceptions. They're your rights, she says. "Know them, demand them, defend them."</p> <p>&nbsp;</p> <p>December 10 commemorates the day General Assembly members adopted the Universal Declaration of Human Rights (UDHR) in 1948.</p> <p>&nbsp;</p> <p>World leaders pledged to "complement the UN Charter with a road map to guarantee the rights of every individual everywhere."</p> <p>&nbsp;</p> <p>As a result, the Universal Declaration of Human Rights was discussed at the General Assembly's first session in 1946. It submitted the UNHR to the Economic and Social Council "for reference to the Commission on Human Rights for consideration....in its preparation of an international bill of rights."</p> <p>&nbsp;</p> <p>Eleanor Roosevelt chaired the UDHR drafting committee. Seventeen other political, cultural and religious figures joined her. She perhaps was its driving force.</p> <p>&nbsp;</p> <p>In September 1948, its first draft was completed. Over 50 member states participated in its final drafting. On December 10, 1948, UN Resolution 217 A (III) adopted UNHR. No members dissented. Eight abstained. Despite emerging Cold War tensions, common ground was found.</p> <p>&nbsp;</p> <p>UNHR's 30 articles pledged "to promote respect for (fundamental human) rights and freedoms....both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction."</p> <p>&nbsp;</p> <p>It affirmed life, liberty, security and dignity. Said no one should be held in bondage or subjected to cruel, inhuman or degrading treatment. It scorned arbitrary arrests, detention, exile, and other human rights violations.</p> <p>&nbsp;</p> <p>It said everyone may leave any country and return freely. It deplored discrimination of any kind. It championed free expression, assembly, movement, thought, opinion and religion.</p> <p>&nbsp;</p> <p>It said everyone has the right to work and receive equal pay for equal employment. It supported essential rights to healthcare, food, clothing, housing, and education.</p> <p>&nbsp;</p> <p>It said "(n)othing in this Declaration may be interpreted as implying for the State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein."</p> <p>&nbsp;</p> <p>World War II atrocities inspired it. The UN Charter's Preamble vowed:&nbsp;</p> <ul> <li>&nbsp;</li> <li>"to save succeeding generations from the scourge of war...."</li> </ul> <p>&nbsp;</p> <ul> <li>"to reaffirm faith in fundamental human rights...."</li> </ul> <p>&nbsp;</p> <ul> <li>to assure justice and international law is respected, and</li> </ul> <p>&nbsp;</p> <ul> <li>"to promote social progress and better standards of life in larger freedom...."</li> </ul> <p>&nbsp;</p> <p>Since founded in 1945, the world body failed dismally on all counts, despite modest successes in areas of health, education, food assistance, refugees, and more.</p> <p>&nbsp;</p> <p>Hamstrung by America and its imperial partners, international law was trashed, permanent global wars rage, and human rights and democratic values became meaningless figures of speech.</p> <p>&nbsp;</p> <p>Israel's Deplorable Human Rights Record</p> <p>&nbsp;</p> <p>On December 6, a <a href="http://www.haaretz.com/print-edition/opinion/human-rights-in-israel-are-in-jeopardy-1.399755"><span>Haaretz editorial</span></a> headlined, "Human rights in Israel are in jeopardy," saying:</p> <p>&nbsp;</p> <p>"Israel ratified the Universal Declaration of Human Rights," but never observed them.</p> <p>&nbsp;</p> <p>Israel's Knesset commemorates Human Rights Day on December 6. "However, it is hard to say the Knesset members are bound to it or to its spirit and principles, most of which are reflected in the founding document of the State of Israel - the Declaration of Independence."</p> <p>&nbsp;</p> <p>In its newly released 2011 human and civil rights report, the Association for Civil Rights in Israel revealed alarming violations. They include infringements on free expression, assembly, movement, political activity, and religion.</p> <p>&nbsp;</p> <p>They show protests aren't tolerated, women are politically, economically and social marginalized, discrimination is worse than ever, social rights are fast eroding, democratic values barely exist, and Occupied Palestinians face daily state terror.</p> <p>&nbsp;</p> <p>"It is hard to believe (Israel) lurk(s) at the threshold of" destroying a free society entirely.</p> <p>&nbsp;</p> <p>In its 2011 human rights report on Israel, Amnesty International (AI) condemned its systematic violations. Those listed include judicial unfairness, administrative detentions without charge, besieged Gaza, home demolitions, illegal settlements, torture and excessive use of force, free movement, speech and assembly restrictions, collective punishment of an entire population, and prosecution and imprisonment of refuseniks against militarism and occupation.</p> <p>&nbsp;</p> <p>Daily headlines offer more proof. Past and present IDF commanders support violence in all forms. So do Netanyahu and dominant Knesset members.</p> <p>&nbsp;</p> <p>Israeli Arabs wonder what's next. So do Jews. Many vote with their feet and leave. Others took steps to follow, and still more consider going because of deteriorating social conditions, extremist governance, and constant threats of war.</p> <p>&nbsp;</p> <p>Palestinians are especially endangered. Israeli incursions terrorize communities regularly. Peaceful protests are confronted violently. Gazans are bombed and invaded. Soldiers shoot children too close to Israel's border. Others are arrested and imprisoned.</p> <p>&nbsp;</p> <p>Torture is official policy. So are targeted assassinations, illegal settlements, home demolitions, land theft, dispossessions, mass arrests and imprisonment, state terror, occupation, persecution, and loss of all rights.&nbsp;</p> <p>&nbsp;</p> <p>Jews are at risk like Arabs if they resist. Challenging state policy leaves no one safe. Police state justice rules. Democracy is a figure of speech. It's fast disappearing entirely.</p> <p>&nbsp;</p> <p>America's Deplorable Human Rights Record</p> <p>&nbsp;</p> <p>Notably under Bush and Obama, America's human rights record is scandalous.&nbsp;</p> <p>&nbsp;</p> <p>Perhaps George Bernard had them in mind when he said:</p> <p>&nbsp;</p> <p>"Democracy is a form of government that substitutes election by the incompetent many for the appointment of the corrupt few.”</p> <p>&nbsp;</p> <p>Obama especially upheld the tradition and then some. He's done what supporters thought impossible. He's governed to the right of George Bush domestically and abroad.</p> <p>&nbsp;</p> <p>He looted the nation's wealth, wrecked the economy, and consigned growing millions to impoverishment without jobs, homes, savings, social services, or futures.</p> <p>&nbsp;</p> <p>His weapon of choice is war. He's waging them globally on humanity and threatening more, perhaps with nuclear weapons. He deployed Special Forces death squads in over 120 countries.&nbsp;</p> <p>&nbsp;</p> <p>He presides over the world's largest gulag. He claims the right to detain US citizens indefinitely without charge. He believes democratic values are impediments to world dominance.</p> <p>&nbsp;</p> <p>He's heading America rapidly toward tyranny. He continued the worst Bush policies and added others. He uses repressive homeland police state tactics against enemies.</p> <p>&nbsp;</p> <p>He targets Muslims, Latino immigrants, dissenters, whistleblowers, social justice/anti-war advocates, and environmental and animal rights called terrorists. He authorized killing US citizens abroad based on unproved suspicions of terrorism.</p> <p>&nbsp;</p> <p>He spies more aggressively domestically than George Bush. He's destroying public education and hard won labor rights. He's eroding Medicare, Medicaid, Social Security, &nbsp;public pensions, and living wage security in decent jobs.</p> <p>&nbsp;</p> <p>He supports wealth and power at the expense of growing needs. He impoverished a third of US households. He's destroying middle class society.&nbsp;</p> <p>&nbsp;</p> <p>He trashed constitutional and international laws to reign terror globally. He made America universally feared and hated. He turned it into an armed camp. He made it unfit to live in socially, economically and politically.</p> <p>&nbsp;</p> <p>He's risking global war for wealth, power, and unchallenged dominance. He created crisis conditions threatening humanity's survival. He reserved the right to use America's superweapons preemptively to do it. There's no place to hide or be safe.</p> <p>&nbsp;</p> <p>Challenging Rogue State Dominance</p> <p>&nbsp;</p> <p>Post-WW II, what human rights supporters envisioned lies in ruins. OWS supporters say "the only solution is world revolution." They represent a cross-pollination for a new nation.</p> <p>&nbsp;</p> <p>They're grassroots activists for change. They want social justice replacing today's dysfunctional system. They want government of, by and for everyone. They know getting it comes bottom up, not top down.&nbsp;</p> <p>&nbsp;</p> <p>They understand struggles this vital are too important to lose. This one's the mother of them all. They know change won't come easily or quickly.</p> <p>&nbsp;</p> <p>They want others joining them for what everyone deserves. New Hampshire's state motto is "Live free or die." Resisting tyranny is a universal right. Jefferson called it "obedience to God."</p> <p>&nbsp;</p> <p>John Locke said when government fails its people, its "trust must necessarily be forfeited, and the Power devolve into the hands of those that gave it, who may place it anew where they shall think best for their safety and security."</p> <p>&nbsp;</p> <p>Henry David Thoreau "Civil Disobedience" essay said:</p> <p>&nbsp;</p> <p>"Must the citizen ever for a moment, or in the least degree resign his conscience to the legislator?"</p> <p>&nbsp;</p> <p>"The only obligation which I have a right to assume is to do at any time what I think right."</p> <p>&nbsp;</p> <p>"All men recognize the right of revolution; that is, the right to refuse allegiance to, and to resist, the government, when its tyranny or its inefficiency are great and unendurable."</p> <p>&nbsp;</p> <p>Essayist Ralph Waldo Emerson, Martin Luther King, and others believed unjust governance should be resisted.</p> <p>&nbsp;</p> <p>So did Jefferson in the Declaration of Independence, saying people have a "right" and "duty to throw" them off, "and to provide new Guards for their future security."</p> <p>&nbsp;</p> <p>People have enormous power to use. Saul Alinsky said, "The only way to beat organized money is with organized people."&nbsp;</p> <p>&nbsp;</p> <p>The time is now. Denying it is criminal.</p> <p>&nbsp;</p> <p>Water and sanitation are recognized as indispensable human rights. In July 2010, the General Assembly's Resolution 64/292 affirmed it. It called on member states and international organizations to:</p> <p>&nbsp;</p> <p>"provide financial resources, build capacity and transfer technology, particularly to development countries, in scaling up efforts to provide safe, clean, accessible and affordable drinking water and sanitation for all."</p> <p>&nbsp;</p> <p>Dozens of countries incorporated water rights in their constitutional or statute laws. Most, however, haven't fulfilled promised goals.</p> <p>&nbsp;</p> <p>In her 2002 book titled, <a href="http://www.amazon.com/Water-Wars-Privatization-Pollution-Profit/dp/089608650X"><span>"Water Wars: Privatization, Pollution, and Profit,” </span></a>activist/ecologist Vandana Shiva called water rights natural and "usufructuary....water can be used but not owned."</p> <p>&nbsp;</p> <p>It belongs to everyone as an essential "basis of all life. (U)nder customary laws, the right to water has been accepted as a natural, social fact."</p> <p>&nbsp;</p> <p>Shiva's nine water democracy principles, include:</p> <p>&nbsp;</p> <p>(1) it's nature's gift;</p> <p>&nbsp;</p> <p>(2) it's essential to life;</p> <p>&nbsp;</p> <p>(3) "life is interconnected through water;"</p> <p>&nbsp;</p> <p>(4) it must be free "for sustenance needs;"</p> <p>&nbsp;</p> <p>(5) it's limited and exhaustible;</p> <p>&nbsp;</p> <p>(6) it must be conserved;</p> <p>&nbsp;</p> <p>(7) it's a commons;</p> <p>&nbsp;</p> <p>(8) "no one has a right to overuse, abuse, waste, pollute," or own it; it belongs to everyone; it can't be treated as a commodity; and</p> <p>&nbsp;</p> <p>(9) there's no substitute.</p> <p>&nbsp;</p> <p>The International Covenant on Economic, Social and Cultural Rights (ICESCR) affirms adequate clean water as an essential human right.</p> <p>&nbsp;</p> <p>The Committee on Economic, Social and Cultural Rights' (CESCR) Comment No. 15 states:</p> <p>&nbsp;</p> <p>"(T)he human right to water entitles everyone to sufficient, safe, acceptable, physically accessible and affordable water for personal and domestic uses."</p> <p>&nbsp;</p> <p>In violation, Israel arbitrarily disconnects or excludes Palestinians from water sources, services or facilities. It contributes to polluting and reducing their resources. It fails to protect their distribution systems.&nbsp;</p> <p>&nbsp;</p> <p>It hasn't adopted or implemented a water policy designed to ensure equitable supplies for everyone. It also failed to provide Palestinians with essential minimum availability to allocate disproportionate amounts to settlers and Israeli Jews.</p> <p>&nbsp;</p> <p><span><a href="http://www.alhaq.org/advocacy/targets/european-union/501-the-right-to-water-a-policy-of-denial-and-forced-displacement-in-the-occupied-palestinian-territory">Al-Haq's Report</a></span> on Israel's Water Policy</p> <p>&nbsp;</p> <p>On November 29, the human rights organization Al-Haq published a report titled, "The Right to Water - A Policy of Denial and Forced Displacement in the Occupied Palestinian Territory," saying:</p> <p>&nbsp;</p> <p>For many years, Palestinians "suffered from a shortage of clean, safe water." With several productive aquifers, the Jordan River, and other natural water sources, scarcity's not the issue.</p> <p>&nbsp;</p> <p>Israeli policy's at fault. By appropriating and controlling Palestinian water sources, unequal distribution resulted. Systematic discrimination allocates most water to Israel, its settlements, and East Jerusalem's Jewish communities.</p> <p>&nbsp;</p> <p>As a result, Palestinians have been gravely impacted. Around 313,000 people in 113 communities aren't connected to a water network. They depend on costly private sources delivered by truck. Another 50,000 in 151 communities have less than 30 liters per capita daily (lpcd).</p> <p>&nbsp;</p> <p>The World Health Organization (WHO) recommends minimally 100 lpcd. Average daily Palestinian consumption is 70 lpcd. Many communities get only 20. WHO calls it the minimum amount for "short-term survival" in emergency/disaster situations.</p> <p>&nbsp;</p> <p>The inequality level between Jews and Arabs is appalling. Israel's Dead Sea Mitzpe Shalem and Qalya settlements consume about 700 lpcd. Beda'ot and Ro'i Jordan Valley settlements enjoy over 400 lpcd solely for household use.</p> <p>&nbsp;</p> <p>Nearby Palestinian al-Hadidya village gets 22 lpcd. About 500,000 West Bank settlement Jews consume around six times more water than 2.5 million Palestinians. Including agricultural use, the disparity's much greater.</p> <p>&nbsp;</p> <p>Israel appropriates 70% of Eastern Aquifer water. Palestinians without springs, wells and other natural sources must travel long distances for access or pay exorbitant privatized prices. In contrast, settlers enjoy plentiful supplies for drinking, irrigation, gardens, and swimming pools.</p> <p>&nbsp;</p> <p>Around 1.6 million Gazans have one source only - the Coastal Aquifer's southern end. Israel denies importing water from natural supplies. To compensate, Palestinians over-used their one source at twice its annual sustainable yield. As a result, Gazan water quality experienced progressive deterioration.&nbsp;</p> <p>&nbsp;</p> <p>While Gazans have marginally more water than West Bank Palestinians, 90 - 95% of it "is polluted by raw sewage and the infiltration of seawater, which is itself contaminated by raw sewage."</p> <p>&nbsp;</p> <p>As a result, serious waterborne diseases are common, including "watery diarrhea and acute bloody diarrhea." Both are major causes of death. In addition, the Coastal Aquifer has nitrate levels exceeding WHO standards by up to 1,600% and chloride ones of 1,200%.</p> <p>&nbsp;</p> <p>Under siege, moreover, materials necessary to improve water and sanitation infrastructure are denied. Through mid-2011, 17 water and sanitation projects were on indefinite hold due to lack of what's needed to implement them.</p> <p>&nbsp;</p> <p>It's estimated that all natural Gazan water will be unusable by 2016. As a result, the Strip will be unfit for human habitation.</p> <p>&nbsp;</p> <p>In the West Bank's Israeli controlled Area C, Palestinian cisterns, wells and springs are regularly destroyed. At times, water infrastructure is also to free more water up for settlers. Israel also targets rooftop storage containers, water tankers and tractors used to transport water, including ones belonging to humanitarian organizations.</p> <p>&nbsp;</p> <p>From January - July 2011, 755 Palestinians were forcibly displaced following destruction of their homes as well as water and irrigation infrastructure. The welfare of another 1,400 were also adversely affected.</p> <p>&nbsp;</p> <p>In addition, settlers regularly attack Palestinian water sources and infrastructure. Vandalism includes filling a distribution pipe with concrete, dumping raw sewage, diapers, and chicken carcasses into spring water, and using large rocks to impede its flow. These and others like them happen regularly with impunity.</p> <p>&nbsp;</p> <p>Israel's Separation Wall not only steals Palestinian land, it denies them access, including often to water sources. In fact, the Wall's path "clearly places control of Palestinian water sources in the hands of Israel." It entirely denies them access to the water-rich Western Aquifer.</p> <p>&nbsp;</p> <p>Cut off from two-thirds of their land, Jayyus villagers get only 23 lpcd. In summer, it's rationed to two hours daily. Qalqilya's 43,000 residents have been separated from 80% of their agricultural land as well as 11 wells.</p> <p>&nbsp;</p> <p>International law obligates Israel to fulfill its occupying power obligations. So do numerous UN resolutions about respecting Fourth Geneva and other human rights and humanitarian law provisions.&nbsp;</p> <p>&nbsp;</p> <p>Israel spurns all international laws with impunity, including to nondiscrimination, work, housing, property, healthcare, education, and environmental health. They get away with it because world leaders don't enforce accountability.</p> <p>&nbsp;</p> <p>A Final Comment&nbsp;</p> <p>&nbsp;</p> <p>On November 30, the Palestinian Center for Human Right (PCHR) noted that December 3 marks UN International Day of Disabled Persons (IDoDP).</p> <p>&nbsp;</p> <p>In 1992, the General Assembly proclaimed it to stress respecting, advocating and protecting their rights globally.</p> <p>&nbsp;</p> <p>Nonetheless, disabled Palestinians are abused, not protected. Since January, Israeli soldiers killed two disabled children, saying they encroached too close to Israel's border. Testimonial evidence refutes it.</p> <p>&nbsp;</p> <p>Moreover, one child suffered from partial mental disability and speech impediments. Yet, 400 meters inside Gaza, ten bullets, mostly to the head, killed him. Shrapnel from an Israeli shell killed the second one. He was 300 meters from Israel's border.</p> <p>&nbsp;</p> <p>Since the beginning of the September 2000 second Intifada, Israeli soldiers killed 89 disabled Palestinians, including 15 children and seven women. They also wounded at least another 105.</p> <p>&nbsp;</p> <p>Moreover, 45 physically or emotionally disabled Palestinians are incarcerated in Israeli prisons under appalling conditions. Some suffer from muscle paralysis or atrophy. Others lost limbs. Some were offered essential medical care only in exchange for spying for Israel.</p> <p>&nbsp;</p> <p>Others experienced other abusive treatment. Overall, security forces make no effort to avoid further harm to disabled Palestinians. Instead of helping and protecting them, they exploit their limitations to enforce occupation harshness.</p> <p>&nbsp;</p> <p>Rights afforded them under the 1999 Palestinian Disability Law Number 4 are denied, including Article Two, stating:</p> <p>&nbsp;</p> <p>"The disabled have the right to enjoy a free life, dignified living, and various services in manner equal to that of other citizens and he/she shall have the same rights and obligations that are within his/her capabilities. It is not permissible to prevent any disabled (person) from enjoying these rights because of his/her disability."</p> <p>&nbsp;</p> <p>Like its other legal obligations, Israel spurns special protections for disabled persons, children, the elderly, infirm and ill.</p> <p>&nbsp;</p> <p>In Israel and Occupied Palestine, only Jews matter. Increasingly, only privileged ones like in America and other Western societies.</p> <p>&nbsp;</p> <p>Others are marginalized, exploited and forgotten. Social justice long ago was abandoned to enrich profiteers and top 1% elites.&nbsp;</p> <p>&nbsp;</p> <p>Why else would rage be spreading everywhere for rights much too long denied. Its newly released 2011 report cites increasing crackdowns on basic freedoms. More on it below.</p> <p>&nbsp;</p> <p>Losing free expression and assembly rights threatens others. They're basic ones Israel's High Court affirmed.</p> <p>&nbsp;</p> <p>It said the "true test of freedom of expression lies in allowing the airing of views that are extreme, controversial, or infuriating." It's the state's obligation to protect them, including in public gatherings.</p> <p>&nbsp;</p> <p>Israel ratified all core international human rights conventions relating to free association rights, including the 1966 International Covenant on Civil and Political Rights (ICCPR). It requires signatories to respect the right to life, due process, judicial fairness, free and open elections, and freedoms of expression, assembly and religion.</p> <p>&nbsp;</p> <p>Free expression and assembly are basic rights in all democracies. Although not enshrined in Israeli Basic Law, they're recognized in case law. Former High Court President Justice Aharon Barak said:</p> <p>&nbsp;</p> <p>(A) demonstration of a political or social character is a manifestation of the autonomy of individual will, freedom of choice and freedom of negation that are included in the framework of human dignity as a constitutional rights."</p> <p>&nbsp;</p> <p>The Court also ruled:</p> <p>&nbsp;</p> <p>"The freedom of expression and demonstration is intended to protect not only those who hold accepted and popular opinions, but also - and herein lies the principal test of freedom of expression - opinions that are liable to incur anger or outrage."</p> <p>&nbsp;</p> <p>Article 21 of the International Covenant on Civil and Political Rights (ICCPR) also enshrines freedom to demonstrate, stating:</p> <p>&nbsp;</p> <p>"The right of peaceful assembly shall be recognized. No restrictions may be placed on the exercise of this right other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order, the protection of public health or morals or the protection of the rights and freedoms of others."</p> <p>&nbsp;</p> <p>Israel claims human rights laws don't apply in Palestine. In fact, they're more important there than anywhere because occupied people are vulnerable. International human rights and humanitarian laws protect them, or they should.</p> <p>&nbsp;</p> <p>It's especially unreasonable for a population occupied and denied basic rights long-term to be quiescent about it. It's their right to demonstrate and speak freely for liberation and justice.</p> <p>&nbsp;</p> <p>However, Israel's August 1967 Order No. 101: "Order Regarding Prohibition of Incitement and Hostile Propaganda Actions" says any assembly, vigil, or procession of ten or more persons requires a permit from the commander of the military forces in the area, if the gathering is intended for the purpose of "a political matter or one liable to be interpreted as political."</p> <p>&nbsp;</p> <p>In fact, all politically-reacted acts, including public speech, require military permission by permit. Violators are subject to arrest, imprisonment and/or fines. The order imposes lawless free expression and assembly restrictions.</p> <p>&nbsp;</p> <p>It assumes groups of 10 or more constitute intrinsic and a priori public dangers, regardless of their purpose or nonviolent nature. As a result, it prohibits fundamental human and civil rights.</p> <p>&nbsp;</p> <p>Israel's anti-democratic Knesset is imposing similar lawlessness internally. ACRI addressed it in its 2011 State of Human Rights Report. It discussed various means Israel uses to silence social protests and stifle democratic debate.</p> <p>&nbsp;</p> <p>Escalation began after last summer's social justice protests across Israel for long denied rights. Arrests followed. Release depended on promising "not to attend demonstrations in the near future."</p> <p>&nbsp;</p> <p>Others received police or Shin Bet summons. They were warned about possible consequences of their behavior.&nbsp;</p> <p>&nbsp;</p> <p>Despite regulations requiring police to wear uniforms with ID badges at all times, increasingly they confronted protesters covertly to disperse demonstrations in Sheikh Jarrah and elsewhere.</p> <p>&nbsp;</p> <p>They did as well during home demolitions in al-Araqib and Lod, while serving evictions notices in Silwan, and for Havat Gilad residents.</p> <p>&nbsp;</p> <p>Israeli and West Bank political activists were summoned before security forces for "warning talks." An Israeli Arab Tarabut-Hithabrut member, an Arab-Jewish Movement for Social &amp; Political Change, was challenged. So was an Israeli Arab university student for protesting Cast Lead abuses.</p> <p>&nbsp;</p> <p>Two Anarchists Against the Wall activists were briefly detained for law breaking when, in fact, they participated in peaceful protests.&nbsp;</p> <p>&nbsp;</p> <p>ACRI criticized recent Knesset bills jeopardizing basic freedoms, including expression, assembly, thought and opinion. Israel's "boycott law" is particularly repressive.</p> <p>&nbsp;</p> <p>It permits sanctions against supporters of anti-Israeli boycotts and "discriminates against people holding certain political views and greatly hurts a legal, legitimate and nonviolent means of protest."</p> <p>&nbsp;</p> <p>Israel's Naqba Law was also cited. It withholds funding from organizations that oppose its core principles and "does great damage to the freedom of political expression, to artistic freedom, and to the right to demonstrate.</p> <p>&nbsp;</p> <p>The report also addresses human rights violations against children and foreign nationals held in detention facilities and silenced social rights in Israel. It exposes emerging Israeli fascism and sham democracy.</p> <p>&nbsp;</p> <p>Israel long ago abandoned its pretense. Military tribunals try Palestinians. Virtually everyone is guilty by accusation. A new study says so. More on that below.</p> <p>&nbsp;</p> <p>In April 2008, the <a href="http://addameer.info/wp-content/images/defending-palestinian-prisoners.pdf"><span>Addamer Prisoners Support and Human Rights Association</span></a> published a report titled "Defending Palestinian Prisoners: A Report on the Status of Defense Lawyers in Israeli Courts."</p> <p>&nbsp;</p> <p>It explained obstacles lawyers representing Palestinians face in court. They're hampered by military orders, Israeli laws, and prison procedures that prevent them from adequately helping clients. They're hamstrung from time of arrests through detentions, interrogations, trials, imprisonments, appeals, and other constraints against justice.</p> <p>&nbsp;</p> <p>Yet international law is clear and unequivocal. Article 2, section 3(b)(c) of the International Covenant on Civil and Political Rights (ICCPR) states:</p> <p>&nbsp;</p> <p>....(P)ersons "shall have (the) right (to effective remedy through a) competent judicial, administrative or legislative (authority), or by any other competent authority provided for the legal system of the State (to) ensure that the competent authorities shall enforce (judicial) remed(ies)."</p> <p>&nbsp;</p> <p>Article 14, section 1 states:</p> <p>&nbsp;</p> <p>"All persons shall be equal before the courts and tribunals (and) shall be entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law." They shall "be presumed innocent until proved guilty according to law."</p> <p>&nbsp;</p> <p>They're also entitled to competent counsel, private lawyer-client sessions, and confidentiality of oral and written communications between them.</p> <p>&nbsp;</p> <p>Addameer explained what, in fact, occurs. Palestinians are entirely denied justice. Those accused are judged guilty. Attorneys get to see clients for the first time on hearing days moments ahead of when they begin. No preparation is possible.&nbsp;</p> <p>&nbsp;</p> <p>After arrest, Palestinians go first to interrogation centers. They may be held without judicial order for eight days and thereafter indefinitely. Lawyers have no access for up to 90 days, and prisoners have virtually no other outside contact during detention.&nbsp;</p> <p>&nbsp;</p> <p>Children young as 10 are treated like adults. Interrogations usually involve torture, intimidation and/or other types of abuse. Rule of law principles don't apply.</p> <p>&nbsp;</p> <p>Those charged are imprisoned or detained. Bail virtually never is allowed. Administrative detainees are taken to Israeli prisons for six months after which they're subject to indefinite extensions.</p> <p>&nbsp;</p> <p>Even learning where clients are held is daunting. One attorney said:</p> <p>&nbsp;</p> <p>"I feel like they're using these procedures to pressure lawyers like me to quit."</p> <p>&nbsp;</p> <p>Jewish lawyers are less obstructed than Arab ones, but obstacles impeding judicial fairness hamper prisoners and counsel throughout the process.</p> <p>&nbsp;</p> <p>For example:</p> <p>&nbsp;</p> <p>Lawyers require permission any time to visit clients. They must have proof of power of attorney from prisoners' families even though requiring it has no legal basis. Moreover, getting it is burdensome given travel restrictions.</p> <p>&nbsp;</p> <p>Meeting prisoners requires knowing where they're held; learning when they're moved and where; dealing with orders barring meetings with clients; enduing daunting travel through checkpoints; long waits inside prisons; limited time with clients; speaking to them by phone through thick plastic windows; constant monitoring by authorities; and restricted access to documents.&nbsp;</p> <p>&nbsp;</p> <p>Some attorneys call these obstacles "a way of making the lawyer think a thousand times before deciding to visit the prison."</p> <p>&nbsp;</p> <p>In military courts, scheduling is another problem. Lawyers must arrive by 9:30 AM, then endure unreliable timetables for hearings. An entire day may be consumed for a 15-minute one, and some attorneys say that they waited until 7PM for it to begin.&nbsp;</p> <p>&nbsp;</p> <p>They also explain that they're treated like prisoners themselves because their clients have virtually no hope for justice. Nonetheless, they do their best under a system rigged to convict.</p> <p>&nbsp;</p> <p>Entering facilities is nerve-wracking and intimidating. West Bank lawyers can't drive to military courts on the grounds that they pose security threats. Once there, they endure long waits to be admitted.&nbsp;</p> <p>&nbsp;</p> <p>Soldiers must unlock gates. Some are cooperative, others aren't, and then they must clear security. Those in Islamic dress are especially pressed to prove they're lawyers, not terrorists seeking entry.</p> <p>&nbsp;</p> <p>One attorney described his Gaza experience, saying:</p> <p>&nbsp;</p> <p>"As a lawyer, you are a cow. They treat us like they are trying to milk us. They squeeze everything from us: our dignity, our time - everything."</p> <p>&nbsp;</p> <p>Language is another problem. Court proceedings are in Hebrew. Lawyers must be proficient to understand them. Palestinians may require Arabic translations. The process is "uneven" at best.&nbsp;</p> <p>&nbsp;</p> <p>Moreover, translators speak quietly. Detainees may not understand them. As a result, they can't follow proceedings properly. Nor can their families consigned to the back of courtrooms when they're allow in at all.</p> <p>&nbsp;</p> <p>In addition, all confessions, statements, police reports, military codes and judicial rulings are in Hebrew without translation, even though Arabic is an official language in Israel.</p> <p>&nbsp;</p> <p>Under West Bank military orders, unauthorized political activities are crimes, including putting up posters, writing slogans on walls, being members of certain political parties or organizations, displaying Palestinian flags or symbols, attending demonstrations, and socializing with persons called security threats.</p> <p>&nbsp;</p> <p>Lawyers also may face months of delay to learn charges against clients. They're often vague without details, including about alleged offenses, dates, time and where occurred plus evidence that wouldn't hold up in legitimate proceedings.</p> <p>&nbsp;</p> <p>Worse still, secret evidence is used, unavailable to counsel. One lawyer said it's "like entering a dark room and not knowing where to go or what to do." As a result, defending clients properly is impossible. With little to go on, lawyers make educated guesses based on previous cases, hoping they apply this time.</p> <p>&nbsp;</p> <p>They also can't call witnesses in detention hearings. When allowed, they may only testify on matters of family life, moral character, and other factors unrelated to charges.</p> <p>&nbsp;</p> <p>Israeli Arabs are as vulnerable as Palestinians. They may be tried in military courts, and according to Israeli law "test of most connection," Jerusalem Arabs come under military courts if accused of acts constituting security threats in the eyes of authorities.</p> <p>&nbsp;</p> <p>Around 98% of the time, plea bargains, not trials, settle charges. Lawyers prefer them because:</p> <ul> <li>&nbsp;</li> <li>most often they serve clients best under a system rigged to convict;&nbsp;</li> </ul> <p>&nbsp;</p> <ul> <li>civil cases (when held) must be completed in nine months, but military ones may take two years without bail for charges bringing shorter sentences;</li> </ul> <p>&nbsp;</p> <ul> <li>the ordeal of trial and detention, family separation, and other systemic inequities means clients are better served by ending proceedings faster;</li> </ul> <p>&nbsp;</p> <ul> <li>going to trial and losing may bring harsher sentences; and</li> </ul> <p>&nbsp;</p> <ul> <li>lawyers hope leniency will result by cooperating with prosecutors.</li> </ul> <p>&nbsp;</p> <p>Appealing decisions in Military Courts of Appeals is daunting. In cases involving security threats, appellate reviews don't help. Nearly always, this court has final say. Rarely does Israel's High Court review their decisions.</p> <p>&nbsp;</p> <p>Lawyers vent their frustration, saying:</p> <p>&nbsp;</p> <p>"The whole process is oppressive."</p> <p>&nbsp;</p> <p>"I learned how to help people, but it's just not possible in the military courts. They exist to administer the occupation, not the law. I feel helpless."&nbsp;</p> <p>&nbsp;</p> <p>"The most frustrating thing is that you have to work within the occupation. You oppose the system, but you have to work within it."&nbsp;</p> <p>&nbsp;</p> <p>"I am surprised that anyone can work as a lawyer for administrative detainees without dying of a stroke."</p> <p>&nbsp;</p> <p>"There is the prosecution, a judge, a lawyer, a prisoner. It looks legitimate but it is not. These tribunals should be boycotted."</p> <p>&nbsp;</p> <p>The <a href="http://www.hamoked.org/court-watch.aspx"><span>Hamoked Center for the Defense of the Individual</span></a> discussed "Israeli Case-Law under Scrutiny," saying:</p> <p>&nbsp;</p> <p>"For over forty years, Israel has systematically violated the rights of Palestinians in the Occupied Territories and its obligations under international law."</p> <p>&nbsp;</p> <p>Justice Israeli-style completely abandoned its role. Justices side with prosecutors. Decisions are based on "confidential security material" with no chance to review or challenge. Due process and judicial fairness are entirely absent.&nbsp;</p> <p>&nbsp;</p> <p>"The Israeli courts, whether directly or indirectly, provide a legal seal of approval for the acts of the occupation." They're complicit with state crimes against humanity.</p> <p>&nbsp;</p> <p>On November 29, <a href="http://www.haaretz.com/print-edition/news/nearly-100-of-all-military-court-cases-in-west-bank-end-in-conviction-haaretz-learns-1.398369"><span>Haaretz</span></a> writer Chaim Levinson headlined, "Nearly 100% of military court cases in West Bank end in conviction," saying:</p> <p>&nbsp;</p> <p>"Virtually all - 99.74 percent, to be exact - of cases heard by the military courts in the territories end in a conviction, according to data in the military courts' annual report...."</p> <p>&nbsp;</p> <p>Haaretz got a copy. It also showed appeals courts also side with lower ones. Moreover, they accept two-thirds or prosecutorial appeals, compared to one-third for Palestinians.</p> <p>&nbsp;</p> <p>Civil courts rarely get involved.</p> <p>&nbsp;</p> <p>In 2010, 25 of 9,542 cases ended in acquittal. Another 4% achieve partial success on one or more charges. Once in Israeli courts, Palestinians are guilty by accusation. At best, cooperating may achieve some degree of leniency.</p> <p>&nbsp;</p> <p>It's unsurprising that virtually all Palestinian families have, or have had, fathers, mothers, brothers, sisters, and/or other relatives detained or imprisoned longer-term. Justice in Occupied Palestine doesn't exist.</p> <p>&nbsp;</p> <p>A Final Comment</p> <p>&nbsp;</p> <p>On November 24, <a href="http://www.alhaq.org/documentation/weekly-focuses/496-israeli-soldiers-harass-released-prisoners"><span>Al-Haq</span></a> headlined, "Israeli Soldiers Harass Released Prisoners," saying:</p> <p>&nbsp;</p> <p>Palestinians freed by Israel's October prisoner swap learned "their freedom comes at a price. In recent weeks, large financial rewards are being offered by certain settler groups for the killing of at least four" of them.</p> <p>&nbsp;</p> <p>Israeli officials are also involved. Moreover, former prisoner homes have been raided late at night. "Witnesses reported that the Israeli soldiers threatened the released prisoners" with rearrest, "and vowed not to leave them in peace."</p> <p>&nbsp;</p> <p>Four examples followed, including:</p> <p>&nbsp;</p> <p>Akram `Abd-al-`Aziz Mansour</p> <p>&nbsp;</p> <p>On November 14 at 12:30AM, about 20 soldiers surrounded his home and tried to enter. Told they came unofficially, Mansour refused to let them.&nbsp;</p> <p>&nbsp;</p> <p>Nonetheless, he was confronted at gunpoint and questioned about his plans. He was then ordered to report to Israeli Intelligence for interrogation on December 11.</p> <p>&nbsp;</p> <p>Wa'el Kamel Jalboush</p> <p>&nbsp;</p> <p>On November 18 at 11:30PM, Israeli soldiers raided his home. He was warned against participating in political events organized by Hamas, Fateh or Islamic Jihad. Doing so will subject him to rearrest.</p> <p>&nbsp;</p> <p>`Imad Yaser Mousa</p> <p>&nbsp;</p> <p>On November 19 at midnight, six Israeli soldiers raided him home and searched it. An Israeli officer threatened him, saying:</p> <p>&nbsp;</p> <p>"We know that you are not allowed to leave Jenin and that if you go even one meter outside the area, you will be arrested once more, and I will not be satisfied with just imprisoning you. I will also tear down your house on top of you."</p> <p>&nbsp;</p> <p>Sumoud Yaser Karaja</p> <p>&nbsp;</p> <p>On November 19 at 1:30AM, about 10 Israeli soldiers forcefully entered her home. She was ordered to report to Ofer Prison the next morning for questioning.</p> <p>&nbsp;</p> <p>Kept waiting there on arrival for nine hours, she explained what happened, saying:</p> <p>&nbsp;</p> <p>"The officer threatened me. He told me that the Israeli intelligence is watching my every move and that they will keep watching me until they can put me back in prison. And that when I do get imprisoned again, I will spend my whole life inside and will never be able to leave."</p> <p>&nbsp;</p> <p>Palestinians have endured Israeli state terror for over 44 years. It remains so today. The area included all Jerusalem, Bethlehem, and Beit Sahour, to encompass Christian holy sites.&nbsp;</p> <p>&nbsp;</p> <p>Resolution 181 also called for an Independent Arab state by October 1, 1948, asking:</p> <p>&nbsp;</p> <p>"all Governments and peoples to refrain from taking any action which might hamper or delay the carrying out of these recommendations."</p> <p>&nbsp;</p> <p>The Security Council was to take "the necessary measures as provided for in the plan for its implementation." It was to assure "a just and lasting peace...."</p> <p>&nbsp;</p> <p>Israel's "War of Independence" intervened. Decades later, peace remains elusive. Palestine's still occupied. World leaders never intervened. Over eight million Palestinians, including diaspora ones, await justice.</p> <p>&nbsp;</p> <p>With little meaning or effect, the Committee on the Exercise of the Inalienable Rights of the Palestinian People each year meets at UN headquarters to observe International Solidarity Day. Ceremonial hypocrisy substitutes for liberating policies with teeth.</p> <p>&nbsp;</p> <p>Palestinians deserve action, not ceremonies, for justice so long denied. One day perhaps decades of patience will be rewarded.</p> <p>&nbsp;</p> <p>On November 29, people globally expressed solidarity with Palestine. In Gaza, members of the Beit Hanoun Local Initiative, the International Solidarity Movement, and other Palestinians marched to release balloons with Palestinian flags in Israel's no-go zone.</p> <p>&nbsp;</p> <p>They floated over barriers imprisoning Gazans. They reflected their spirit yearning to be free. Local Initiative member Sabur Zaaneen called on people globally "to isolate Israel internationally and to exert pressure in all its forms until the end of the occupation of Palestine."</p> <p>&nbsp;</p> <p>International Solidarity Movement member Radhika Sainath said, "Today the entire free world is against the settlements, the wall and the Israeli occupation. We will continue our work in Palestine with Palestinian activists until we succeed in bringing freedom and justice to Palestine."</p> <p>&nbsp;</p> <p>Press TV said activists burned Israeli flags, symbolically protesting repression. Gazans "carried Palestinian flags toward the electric fence demarcating the buffer zone." It prevents Palestinians from accessing 30% of Gaza's most arable land.</p> <p>&nbsp;</p> <p>On November 30, Israel sent tanks, bulldozers, and military vehicles to Gaza. Soldiers fired on civilians from watch towers. Artillery shelled homes east of Khan Younis.&nbsp;</p> <p>&nbsp;</p> <p>Farm land in Jahor al-Dik and Maqbola neighborhoods was uprooted. Helicopter gunships hovered overhead. Gaza remains a war zone. Men, women and children are targeted.</p> <p>&nbsp;</p> <p>On November 28, a UN report accused Syria of "gross violations of human rights." Killings and other atrocities committed by Western recruited Al Qaeda insurgents weren't mentioned. Nor was Israel condemned for committing daily crimes against humanity in Palestine.&nbsp;</p> <p>&nbsp;</p> <p>Instead, Secretary-General Ban Ki-moon functions solely as an imperial tool. His agenda excludes peace, equity and justice. As a result, Palestinians, Libyans, Iraqis, Afghans, Yemenis, Bahrainis, Egyptians, Saudis, Somalis, and millions of others suffer horrendously.</p> <p>&nbsp;</p> <p>in mid-November, Ban said nothing about Israel disconnecting Gaza's main electricity grid. Its energy authority head Kanaan Ubeid said, "The Israeli occupation uses security pretexts to justify disconnecting" it for northern Gaza. It's been off for nine days, he added.</p> <p>&nbsp;</p> <p>On November 26, Israel said Gazan water and electricity will entirely be cut off if Fatah and Hamas consummate unity.</p> <p>&nbsp;</p> <p>On November 29, the <a href="http://www.pchrgaza.org/portal/en/?option=com_content&amp;view=article&amp;id=7886:israeli-authorities-prevent-reparation-of-major-lines-providing-electricity-to-the-gaza-strip-for-the-thirteenth-consecutive-day-&amp;catid=36:pchrpressreleases&amp;Itemid=194"><span>Palestinian Center for Human Rights (PCHR)</span></a> condemned Israel for preventing technical crews from repairing a major line carrying electricity to Gaza. For the past two weeks, it's been disrupted.&nbsp;</p> <p>&nbsp;</p> <p>Power's been reduced by 37%. Daily services were impacted. Crisis conditions were aggravated. Gaza Electricity Distribution Company (GEDCO) public relations director Jamal al-Dirdissawi said northern Gaza's been affected.</p> <p>&nbsp;</p> <p>The cut-off coincides with another 20-megawatt reduction for periodic maintenance at a time cold weather increases demand. According to Ahmed Abu al-Amarin, Palestinian Power Authority's Power Information Center head, Gaza needs about 300 megawatts of electricity. Over one-third of it is down.</p> <p>&nbsp;</p> <p>Currently, 188 megawatts are being provided - 108 from Israel, 63 from Gaza's power plant, and 17 from Egypt.</p> <p>&nbsp;</p> <p>Coping with current conditions, GEDCO implemented an emergency plan, involving outages lasting eight hours or more daily. Israel's maliciously exacerbating the problem. International law's being violated. Occupied Palestinians are protected persons. Israel treats them like criminals. World leaders and UN authorities don't intervene.</p> <p>&nbsp;</p> <p>Other Israeli Abuses</p> <p>&nbsp;</p> <p>The <a href="http://www.hamoked.org/home.aspx"><span>Hamoked Center for the Defense of the Individual</span></a> posted other abuses on its web site, including:</p> <p>&nbsp;</p> <p>(1) Timeline: The Separation Wall, saying Israeli construction violates international law, breaches its "authority as a temporary custodian," disrupts normal lives of affected residents, obstructs religious rights by denying access to holy sites, and collectively punishes civilians they're sworn to protect.</p> <p>&nbsp;</p> <p>(2) Bodies of killed Palestinians aren't returned to family members with rare exceptions. Since 1988, Hamoked represented hundreds of aggrieved families. Israel returned dead loved ones for burial only 20 times. Denials given don't wash.</p> <p>&nbsp;</p> <p>(3) Family unification denied: Israel claims Occupied Palestinians aren't entitled to it. Rare approvals granted are "merely....act(s) of benevolence on" its part. As a result, forced separation affects "tens of thousands" of Gazans unable to reunite with families in the West Bank.</p> <p>&nbsp;</p> <p>(4) "Ceased residency:" From 1967 to 1994, Israel revoked the residency of 140,000 West Bank Palestinians. Under military orders, residents traveling abroad got "exit card(s)" in return for depositing their identity cards at border crossings.</p> <p>&nbsp;</p> <p>Valid for three years, those not returning in time were judged "having transferred (their) center of life abroad." As a result, their residency status was revoked. Rarely does Israel let "late returnee(s)" regain it. Denying them violates international law, including the Universal Declaration of Human Rights, stating:</p> <p>&nbsp;</p> <p>"Everyone has the right to leave any country, including his own, and return to his country (Article 13(2) )."</p> <p>&nbsp;</p> <p>Israel spurns all international laws with impunity. Palestinians have no rights whatever.</p> <p>&nbsp;</p> <p>(5) Residency in Jerusalem: Since East Jerusalem's 1967 annexation, Palestinian residents have been oppressed in numerous ways, including through "unseen barriers to everyday life."&nbsp;</p> <p>&nbsp;</p> <p>Like elsewhere in Occupied Palestine, their lives are hellish. From one day to the next, they don't know what's coming, including forced expulsions to make way for Jewish development.</p> <p>&nbsp;</p> <p>Hamoked petitions Israeli courts for justice, including Israel's High Court. Rarely ever is it granted even after Supreme Court rulings affirmed it. Israeli authorities simply obstruct, delay and avoid implementing orders from the highest court. As a result, Palestinians suffer horrendously.&nbsp;</p> <p>&nbsp;</p> <p>Daily human rights abuses are appalling. On November 30 alone, Army bulldozers uprooted Mas-ha village farmland. Stables there were also demolished.</p> <p>&nbsp;</p> <p>Soldiers fired live ammunition near Gaza City. Peace Now activists got death threats, including its director, Yariv Oppenheimer. Offices were threatened with bombings. Extremist settlers are responsible. Authorities do nothing to stop them.</p> <p>&nbsp;</p> <p>Israeli soldiers arrested three Beit Ummar, West Bank youths. Homes were broken into violently. In recent days, 16 other village residents were arrested and detained, including 13 under age 18. Israel treats children like adults.</p> <p>&nbsp;</p> <p>For the third consecutive time, imprisoned Hamas legislator Nayef Rajoub's remand was extended another six months. Palestinians can be detained indefinitely without charge for alleged security reasons. Doing so violates international and Israeli law.&nbsp;</p> <p>&nbsp;</p> <p>Since 1989, Rajoub's been arrested and detained numerous times despite having committed no crimes. So have many other Palestinians for wanting to live free on their own land in peace. Israel calls that "terrorism."</p> <p>&nbsp;</p> <p>Israel interdicted and arrested 10 Palestinian fishermen. Later released, their boats were impounded. Israel obstructs Gazans fishing in their own waters.&nbsp;</p> <p>&nbsp;</p> <p>They're prevented them from earning a living and providing valued catches to residents. Last July, the International Committee of the Red Cross said Gaza's fishing industry almost disappeared. Thousands of Gazans depend on fishing. Israel shuts most out entirely.</p> <p>&nbsp;</p> <p>Palestinian legislator Qays Abdul-Karim was prevented from leaving the West Bank to participate in the Latin American parliament's 27th session. Stopped at the Allenby Bridge crossing to Jordan with a parliamentarian delegation, he was asked where he was going and why.</p> <p>&nbsp;</p> <p>He said to Panama to support ending Israel's occupation. In response, he was told he's barred from traveling. No word on whether arrest and detention followed. Of course, late night raids can seize him any time. They happen with painful regularity.</p> <p>&nbsp;</p> <p>Life in Occupied Palestine is hell. Israel oppresses Palestinians for being Muslims, not Jews. Even Arab citizens aren't safe. Called fifth column threats, they face political, social, economic, cultural and other forms of discrimination.</p> <p>&nbsp;</p> <p><span>In its early November South Africa session, the <a href="http://www.russelltribunalonpalestine.com/en/sessions/south-africa/south-africa-session-%E2%80%94-full-findings"><span>Russell Tribunal on Palestine (RToP)</span></a> accused </span>Israel of "subject(ing) the Palestinian people to an institutionised regime amounting to apartheid as defined under international law."</p> <p>&nbsp;</p> <p>Racist discrimination defines Israeli policy. Occupied Palestinians and Israeli Arabs are affected. Apartheid is an international crime. RToP witnesses presented clear evidence of Israeli apartheid rule, affecting anyone not Jewish.</p> <p>&nbsp;</p> <p>As a result, discrimination, repression, isolation, and other forms of abuse are official policy. Although persecution is a crime against humanity, Israel practices it with impunity.</p> <p>&nbsp;</p> <p>RToP and other human rights advocates are committed to ending all forms of Israeli injustice.
